A majority of the Court of Appeal agreed that our client had been wrongfully dismissed and that she did not repudiate her employment contract when she sued her employer for wrongful dismissal. The case was sent back to the Supreme Court for a calculation of damages.

Lewis v. Lehigh Northwest Cement Limited 2009 BCCA 424

Our client appealed certain aspects of a trial decision in which he was awarded 22 months of severance. We also successfully defended a cross-appeal by the employer where they argued that Mr. Lewis had failed to mitigate his damages.

Jonas McKay is an Associate and practices in the area of employment law litigation, including employment standards and human rights matters.

Jonas has appeared as counsel regularly at Provincial and Supreme Court in British Columbia.  

Some examples of recent cases that Jonas has been involved in are:

  • Representing a senior, long term employee in Supreme Court against his employer’s claim that they had just cause for dismissal 
  • Representing an employee in Supreme Court against her employer’s claim that she had abandoned or resigned from her job
  • Representing an employee in Supreme Court against a claim that she had been constructively dismissed
  • Representing employees in Employment Standards hearings for the recovery of unpaid wages and overtime

Jonas has also assisted clients with the following:

  • Negotiation of settlements in wrongful dismissal actions (senior and short term employees)
  • Negotiation of severance packages (senior and short term employees)
  • Provincial Court and Human Rights Tribunal mediations
  • Preparation of employment agreements

Jonas’s litigation experience also includes work in the personal injury field.
