A majority of the Court of Appeal agreed that our client had been wrongfully dismissed and that she did not repudiate her employment contract when she sued her employer for wrongful dismissal. The case was sent back to the Supreme Court for a calculation of damages.

Our client appealed certain aspects of a trial decision in which he was awarded 22 months of severance. We also successfully defended a cross-appeal by the employer where they argued that Mr. Lewis had failed to mitigate his damages.

Fred Wynne is an Associate practicing as an employment law litigator. Before joining Kent Employment Law, Fred’s practice at a mid-sized Fraser Valley firm included employment law, personal injury and general civil litigation matters. His trial and advocacy work includes appearances in Small Claims Court and before each of the Supreme Court of British Columbia, BC Human Rights Tribunal and Workers’ Compensation Appeal Tribunal.  

Some examples of recent cases that Fred has been involved in are:

  • Representing employees suffering from a variety of “disabilities” (including hip and back pain, cancer, depression, anxiety, PTSD and adjustment disorder) before the BC Human Rights Tribunal (BCHRT)
  • Representing small businesses at the BCHRT and advising such businesses on strategies for accommodating disabled employees
  • Representing a long-term employee in a wrongful dismissal action against a large international corporation (settled)
  • Representing employees in contract disputes regarding commissions and draws

Fred is an active member of both the Canadian Bar Association (BC Branch) and the Trial Lawyers’ Association of British Columbia.  His other contributions to law include co-authoring a chapter for Professor Bruce Ziff’s forthcoming book on adverse possession.

Away from the office, Fred plays rugby with the Kats and enjoys sailing and skiing with his wife Megan.  He is also currently learning to fish, with limited success.
